Terms of Service

1. Acceptance of these terms

These Terms of Service are an agreement between you and Prompted Media LLC, a Texas limited liability company ("we", "us", "our"), and govern your use of the prompted mobile app and this website ("prompted", the "Service"). By creating an account or using prompted, you agree to these terms, to our Privacy Policy, and to the liability waiver you accept in the app (restated in section 7 below). If you don't agree, please don't use prompted.

2. Eligibility

You must be at least 13 years old to use prompted. We verify this at sign-up and refuse accounts for anyone under 13. If you're under 18, you may use prompted only with the permission of a parent or guardian, who agrees to these terms on your behalf and is responsible for your use of the Service. You also confirm that you aren't barred from using the Service under the laws that apply to you.

3. Your account

• Keep your login credentials to yourself. You're responsible for activity on your account.
• One person per account; don't impersonate anyone else.
• Display names must follow our community rules (no slurs, no impersonation).
• You can delete your account at any time — see account deletion.

4. Your content

You own the videos, comments, and other content you post. By posting, you give us a worldwide, non-exclusive, royalty-free license to host, store, process (including automated safety scanning), display, and distribute that content within the Service — including generating shareable branded versions of your videos when you use the share feature. This license ends when your content is deleted, except where content remains as described in our Privacy Policy (for example, posts kept as "[deleted]" after account deletion unless you request a full wipe).

You're responsible for what you post. Only post content you have the right to post. We respond to copyright notices as described in our Copyright Policy, and we terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyrights.

5. Community rules

prompted is meant to be playful, creative, and safe. There is no tolerance for objectionable content or abusive users. Don't post or do any of the following:

• Anything that sexualizes or endangers minors. Zero tolerance — accounts are removed and reported to authorities. See our Child Safety Standards.
• Sexually explicit or pornographic content
• Intimate images of anyone shared without their consent, real or AI-generated. We take them down within 48 hours of a valid request, even from someone without an account: see how to report an intimate image.
• Harassment, bullying, threats, or hate speech (slurs are automatically filtered)
• Graphic violence, gore, or content promoting self-harm
• Illegal activity, or dangerous activity presented for imitation
• Spam, scams, or deceptive behavior
• Other people's private information
• Attempts to break, abuse, or reverse-engineer the Service (including evading rate limits or filters)

6. Moderation and enforcement

To keep the community safe, all uploads are automatically scanned for unsafe content, text is filtered for slurs, and human moderators review user reports — typically within 24 hours. We may, at our discretion: remove or hide content, lock comments, mute accounts, restrict accounts to read-only, or ban accounts temporarily or permanently. Objectionable content and the users who post it may be removed without warning.

7. Assumption of risk and release of liability

prompted gives you creative prompts — some of them involve doing things in the real world. This section restates the waiver you accept in the app:

• Assumption of risk. You voluntarily assume all risks associated with participating in any activities suggested or inspired by the app or its prompts, including but not limited to physical injury, emotional distress, or property damage. Please play responsibly.
• Release of liability. You release, waive, and discharge the app's developers, owners, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to your use of the app, including any activities suggested or inspired by the app or its prompts.
• Responsibility for actions. You are solely responsible for your actions and decisions while using the app. You agree to use the app in a safe and lawful manner.
• Indemnification. You agree to indemnify and hold harmless the app's developers from any claims, damages, or expenses arising from your use of the app.

In this section, "the app's developers, owners, and affiliates" and "the app's developers" mean Prompted Media LLC and its members, managers, employees, contractors, and agents.

Never let a prompt talk you into something unsafe or illegal. Skip it and pick another one.

8. Termination

You can stop using prompted or delete your account at any time. We may suspend or terminate accounts that violate these terms, and we may modify or discontinue the Service (with reasonable notice where practical).

9. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We don't guarantee the accuracy, safety, or suitability of any prompt or any user-posted content. To the maximum extent permitted by law, prompted's developers, owners, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of one hundred U.S. dollars (US$100) or the amount you paid us, if anything, in the twelve months before the claim arose. We aren't responsible for content posted by other users, or for third-party services the Service links to or relies on. Nothing in these terms limits liability that cannot be limited under applicable law, and nothing limits rights you have as a consumer under the laws where you live.

10. Governing law and disputes

These terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules.

Talk to us first. Before filing any claim, you agree to email promptedmod@gmail.com with your name, a description of the problem, and what you're asking for, and to give us 30 days to try to resolve it informally. We'll do the same before bringing a claim against you.

If it isn't resolved, either of us may bring the claim in small claims court where you live, if it qualifies. Otherwise, any claim must be brought exclusively in the state or federal courts located in Travis County, Texas, and you and we consent to their jurisdiction. Claims may be brought only on an individual basis, to the extent the law allows. Any claim relating to the Service must be filed within one year after it arises, unless the law requires a longer period.

11. App stores

If you downloaded prompted from the Apple App Store or Google Play, these terms are between you and Prompted Media LLC only, not Apple or Google. We, not Apple, are solely responsible for the app, its maintenance and support, and any claims relating to it (including product liability, legal or regulatory compliance, and intellectual-property claims). If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You also agree to the app store's own terms of use.

You represent that you are not located in a country subject to a U.S. government embargo, and are not on any U.S. government list of prohibited or restricted parties.

12. General

• Changes. If we make meaningful changes, we'll update the date at the top of this page and let you know in the app. Continuing to use prompted after changes take effect means you accept them.
• Entire agreement. These terms, the Privacy Policy, and the in-app waiver are the whole agreement between you and us about the Service.
• Severability. If any part of these terms is found unenforceable, the rest stays in effect, and that part is enforced to the fullest extent allowed.
• No waiver. If we don't enforce a term right away, we haven't given up the right to enforce it later.
• Assignment. You may not transfer your rights under these terms. We may transfer ours as part of a merger, acquisition, or sale of assets.
